Chickasaw Subdivision Failed

Posted on 03 March 2009 by admin

Annexation of the subdivision was denied by the Missoula City Council, when the Council vote did not reach the super majority required to overcome the petition against the proposal. Chickasaw Place would have been located along South Seventh Street West, approximately 1/4 miles west of Tower Street. The testimony was lengthy and varied during the subsequent two Council Meetings; developers, land owners and many others voiced concerns. The discussion ranged from neighborhood character to property rights.

However, the the issue that caused the most contention was the agricultural set aside required by the city; 3 acres or about 1/3 of the property. The motion failed with 7 aye votes and 5 nays, regardless of the issues.

This subdivision brought to light a serious gap in Missoula Zoning law and inconsistencies in city/county planning regarding agriculture.
